Operator Applicatlon, Performance Warranty, Financial Warranty Certification of Deposit, and
Certificate of Deposit
Dear Mr. Gilmore,
On August 11, 2006, the Division of Reclamation, Mining and Safety received Wells Fargo Certificate of Deposit No.
7680962250, in the amount of $10,667.00, for Benton Dawson Gravel, Permit No. M-1983-209. On September 8,
2006, the Division of Reclamation, Mining and Safety received a revised copy of a Succession of Operator form, a
revised copy of a Performance Warranty, and a revised copy of a Financial Warranty Certification of Deposit. The
Division is returning the Certificate of Deposit and Transfer of Permit and Succession of Operator Application for the
following:
Certificate of Deposit:
The Certificate of Deposit shall be set up as a Public Funds Account (this must be stated on the signature card/sheet, and
the books of the bank). The Division's PDPA nlunber must be shown on the signature card. The Division's PDPA
number is 010004005101.
CD's must be assiened to the State of Colorado/Mined Land Reclamation Boazd. The bank issuing the certificate must
use the Division's address (1313 Sherman St.. Rm 215. Denver, CO 80203); and phone number (3031866-3567) on the
certificate and also on the books of the bank.
The only approved endorsement signature on the CD is the Division Director's. The Division will return the signature
cazd/sheet to the bank with the D'irector's signature.
The interest may not accme or compound against the principal, but should be paid out to the original depositor of the
monies. The interest maybe deposited into a Checking, Savings, or the interest may be paid out. All interest checks,
statements, corespondence pertaining to the CD must be sent to the Division and the Division will then forward the
information to the Original Depositor of the monies.
Transfer of Permit and Succession of Operator Application:
The Division requires the permittee company name (i.e. "Western Slope Construction Company") be listed in
the "Notary for Permittee" section of page 5 in the blank following the word, "of'. Please have your notary
add this information and initial her addition.
Please note that some cotrections have been made on the Transfer of Permit and Succession of Operator Application
by the Division Program Assistant after attaining your verbal permission.
Upon correction, please return these documents to my attention.
