Also, the cooperative agreement delegates the primary, <br />but not exclusive, responsibility for enforcing the Federal lands <br />program within Colorado to the Mined Land Reclamation Division <br />(MLRD), now known as DMG. See 30 C.F.R. § 906.30, Art. VIII, <br />paras. 17-19. <br />Art. VIII, para. 19, of the cooperative agreement provides <br />in relevant part: <br />During any inspection made solely by OSM of any joint <br />inspection where the MLRD and OSM fail to agree <br />regarding the propriety of any particular enforcement <br />action, OSM may take a~ enforcement action necessary, <br />to comply with 30 CFR arts 843 and 845. <br />30 C.F.R. § 906.30 (emphasis added). <br />Part 843 of 30 C.F.R., referred to in Art. VIII, para. 19, <br />above, sets forth general rules regarding, among other things, <br />enforcement of the Federal lands program. 30 C.F.R. § 843.1. <br />Specifically, section 843.12(a)(1) provides: <br />An authorized representative of the Secretary shall <br />issue a notice of violation if, on the basis of a <br />Federal inspection carried out during the enforcement <br />of a Federal lands program ., he finds a <br />violation of the ~plicable grogram which <br />does not create an imminent danger or harm for which a <br />cessation order must be issued under § 843.11. <br />(Emphasis added.) <br />In other words, under Art. VIII, para. 19, of the <br />cooperative agreement, OSM retains certain authority to enforce <br />the Federal lands program within Colorado. Specifically, where <br />OSM finds a violation of the Colorado program on Federal lands <br />not involving imminent danger or harm for which a cessation order <br />must be issued under 30 C.F.R. § 843.11, OSM may take any <br />11 <br />
