Fulton <br />Janunry I8, 2001-Termiwtion Ac(ion at Basin Resources, lnc. <br />Page 2 <br />DMG views the OSM November 9, 2000 "appropriate action" determination as confirmation that, in <br />terminating NOV 00-140-116-001, based on Basin's satisfaction of the 1997 State court judgment, <br />OSM did not intend to preclude DMG from taking enforcement action to address any subsidence <br />damage to the Tatum's residence and related structures, which may have occurred after the date of the <br />1997 State court decision. <br />DMG respectfully requests that OSM provide DMG with written clarification that OSM did not intend <br />either the issuance of NOV 00-140-116-001 or its subsequent termination to preclude the issuance of <br />additional enforcement action based on any subsidence damage that may have occurred to the Tatums' <br />residence and related structures after the date of the State courtjudgment. <br />Thank you for your assistance.
