~ -- III IIIIIIIIIIIIIIII ~ <br />999 <br />aE~~`v~~ <br />V . <br />O`~`SO~ o~ ~~~E~a~s ~~eoW9 <br />CEASE AND DESIST ORDER <br />Based on these same Findings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32.5-124(2),(6) and (7) the Colorado Mined Land <br />Reclamation Board hereby orders Joseph and Arlene Cogan to: <br />1. Cease and Desist from conducting any mining related operations until <br />a permit is issued for the Arnold Gulch Pit, proposed Permit No. M- <br />98-091, Sections 1 & 2, Township 15 South, Range 78 West of the 6th <br />P.M., in Chaffee County, Colorado. <br />2. Complete the following corrective action: <br />Receive final approval for permit application M-98-091 on or before <br />February 10, 1999. <br />Send in written notice of your agreement to comply with this order <br />within one (1) day of receiving this notice. <br />4. Pay the Colorado Mined Land Reclamation Board a civil penalty in the <br />amount of 51,455.16 within thirty (30) days of the signature date of <br />this document. This is based upon an assessment of $1000.00 per day <br />for 19 days of violation ($19,000.00) plus $455.16 for staff time to <br />investigate and present this item to the board, with $18,000.00 <br />suspended upon satisfactory completion of the corrective action <br />outlined in this order. The suspended portion of the civil penalty, <br />in the amount of $18,000.00, will become due and payable on February <br />11, 1999 if the required corrective action is not completed to the <br />satisfaction of the Division of Minerals and Geology. <br />This Cease and Desist Order shall remain in effect until all terms have <br />been satisfied by the operator. v <br />~~~ <br />
