Members of the Mined Land Reclamation Board
Page 5
III. Conclusion
The counties in the State of Colorado receive an exemption from the
payment of permit application fees and the requirement of posting
acceptable financial warranties under section 34-32-111(7) of the
MLRA a:nd section 34-32.5-111(6) of the Act when the purpose of the
permit is for construction of public roads.
However, the requirement to pay annual fees by counties has not
been waived by the General Assembly in § 34-32-111(7), C.R.S. or
§ 34-32.5-111(6), C.R.S. Counties, as operators of construction
materials isand and gravel) mines for the purpose of constructing
public roads, like other minerals reclamation permittees who
qualify under that section of the Construction Materials Act for a
section 111 permit, are required to pay the $625 annual fee
established in § 34-32.5-125, C.R.S. Finally, this fee applies to
all ex:Lsting and future county section 111 permits. See § 34-32.5-
109, C.R.S.
