Mr. Robert Hagen -3- November 18, 1993 <br />Since this activity was approved by the DMG, NOV C-93-1 13 was vacated, and further <br />enforcement action is not warranted. <br />Light-Use Roads <br />The third alleged violation involves the use of light-use roads which were not properly <br />permitted. Based upon information available at the time of the August 12, 1993 inspection, <br />NOV C-93-1 14 was issued by the DMG. MCC requested that this NOV be reconsidered by the <br />Colorado Mined Land Reclamation Board (Board). On October 20, 1993, following a Formal <br />Public Hearing, the NOV was vacated by the Board. Minor Revision No. 107, approved <br />November 18, 1993, designates the subject roads as permitted facilities. Since the roads are <br />properly permitted at this time, additional enforcement action would not be appropriate. <br />Pertinent documents are attached for your review (Exhibit C). <br />Conclusions <br />As discussed above, it is our position that the alleged violations do not exist.
