STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: Earl and Becky Bennett) NOTICE OF VIOLATION <br />1470 Highway 50 ) No. MV-97-026 <br />Delta, Colorado 81416 ) AND <br />CEASE AND DESIST ORDER <br />TO: Earl and Becky Bennett, and all other persons engaged in or owning or controlling the following operation: <br />Bennet Gravel Pit, located in Section I1, Township IS South, Range 96 West, of the 6th P.M., <br />Delta County. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Boazd by C.R.S. 34-32.5-124, <br />the Board hereby makes the following findings of fact: <br />Earl and Becky Bennett are permitted to conduct a mining operation under the terms of Permit M-79-166 <br />located in Section 11, Township I S South, Range 96 West of the 6th P.M., in Delta County, Colorado. <br />2. The Mined Land Reclamation Board conducted a Formal Public Hearing on September 24, 1997 to <br />consider possible violation of the terms of Permit M-79-166 and C.R.S. 34-32:5-101 et sec .. <br />3. The Division of Minerals and Geology presented evidence at the Formal Public Hearing on September 24, <br />1997, demonstrating that: <br />Earl and Becky Bennett had conducted mining activities outside of the approved permi[ area for <br />Permit No. M-79-166. The size of the affected area outside the approved permit boundary was <br />determined to be approximately 2 acres. <br />NOTICE OF VIOLATION <br />Based upon these same Findings of Fact and in accordance with C.R.S. 34-32.5-124(6), the Colorado Mined Land <br />Reclamation Board hereby finds Earl and Becky Bennett to be in violation of Permit M-79-166, specifically <br />Exhibits A and C, and C.R.S. 34-32.5-109. <br />
