Monks Construction Company applied to amend their Airport Pit 93 <br /> permit in Fremont County. During the process of the permit it was discovered that the applicant <br /> had an outstanding civil penalty. When this was brought to their attention, they immediately <br /> submitted the fine. Enclosed you will find a check dated December 20, 1996 for the penalty <br /> amount. <br /> For some unknown reason, this check did not reach you. We discovered this situation on January <br /> 27, 1997. The next day we forwarded a second check to you. A copy of this check is also <br /> enclosed for your reference. You will also note that a stop payment was put on the first check. <br /> The result of this mishap is a delayed decision date until April 29, 1997. This delayed decision <br /> date has put a hardship on Monks because they wish to operate under the terms of the <br /> amendment. We are submitting this material to you to show that Monks did respond quickly <br /> upon notification of the outstanding fine. Unfortunately the check was lost. <br /> We request you consider these circumstances and process the amendment as quickly as the law <br /> allows. We have received approval from Fremont County for their Conditional Use Permit.
