CEASE AND DESIST ORDER <br />Based upon the foregoing Findings of Fact and Notice of Violation, and <br />pursuant to the provisions of C.R.S. 34-32-123, the Board hereby orders you to: <br />Immediately cease and desist all mining operations. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined land <br />Reclamation Board, written notice of your compliance with paragraph one <br />(1) of this Cease and Desist Order. <br />III. CORRECTI`1E ACTIONS <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-124(2), the Board hereby orders the <br />following corrective actions: <br />Obtain by July 23, 1992 a Limited Impact 110 (2) permit for reclamation <br />only of the disturbed area (including redisturbed land). <br />2. Complete the reclamation work approved for the permit above by <br />May 1, 1993. <br />3. The Board further orders you to appear before the Board at its July 22-23 <br />Board Meeting for a report on progress toward theca corrective actions. <br />IV. CIVIL PENALTY <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-123(3), and based upon the foregoing <br />Findings of Fact, the Board hereby assesses a civil penalty against C & J <br />Gravel Products, Inc. in the amount of 57,600.00 based on the maximum of 60 <br />days of violation at 5130.00 per day. The 9oard orders that S1,000.G0 of the <br />civil penalty be paid within 30 days of this Order. The remainder of the <br />civil penalty will be held in abeyance until the Board's July 22-23, 1492 <br />meeting, at which time the hearing will be continued and the Board will <br />consider the remainder of the civil penalty. <br />In clarification of the rights of recipients of Notices of Violation, Cease <br />and Desist Orders, Corrective Actions and Civil Penalties, parties are advised <br />to consult the Colorado Mined Land Reclamation Act and the State <br />Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts <br />to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />
