CV-2001-007 and CV-2001-008, Request for Extension of <br />Abatements Deadlines, and Drill Fluids MSDS Information for Abatement <br />Termination <br />Dear Mr. Dudash: <br />As we had discussed, there has not been a sufficient duration of warm weather <br />to dry the mud pits and soil berms (as well as to thaw the snow within many <br />areas along the berms), so the ground conditions remain inappropriate for proper <br />handling and rework of the soil materials. To allow additional drying time, Oxbow <br />Mining, Inc. ("OMI") requests extensions of the deadlines to the maximum <br />abatement period (90 days from the date of issuance) for the installation of <br />erosion control in the field (abatement No. 1) per NOV No. CV-2001-007 from <br />June 15, 2001, to July 19, 2001, and forimplementingtha approved Minor <br />Revision No. 58 (abatement No. 3) from July 01, 2001 to July 19, 2001. OMI <br />also requests an extension of the deadline for abatement No. 2 of NOV CV-2001- <br />008from July 01, 2001 to July 19, 2001. <br />Attached are copies of the MSDSs for the drilling fluids that have been or may be <br />used during the drilling of the degasification wells. Along with these products, the <br />drill mud generated from the well construction and contained within the mud pits <br />consists of rock and soil particles and water. As none of the drilling mud <br />constituents are hazardous materials requiring special handling, OMI proposes <br />that appropriate disposal of the drilling mud per abatement No.1 is to be buried <br />within the reclaimed mud pits.
