Lnnp <br />Dwivon Director <br />DMG's January 26, 1998 decision to withdraw its RTB enforcement action for unpermitted <br />exploration activities has been challenged. <br />Therefore, DMG has scheduled the matter for Formal Public Hearing before the Colorado <br />Mined Land Reclamation Board for consideration of appeal of DMG's decision to withdraw <br />its RTB and possible hearing to consider whether a violation has occurred. The hearing <br />has been scheduled for the March 25 - 26, 1998 Board meeting at 1313 Sherman Street, <br />Room 318, Denver, Colorado, beginning at 9:00 a.m. or as soon thereafter as the matter <br />can be considered. <br />You will have the opportunity to be represented and heard. It will be reiterated that DMG <br />has withdrawn its previously issued RTB for unpermitted exploration activities. <br />If the Board makes a determination to overturn DMG's decision and finds a violation at the <br />hearing, it may issue a cease and desist order and assess civil penalty of not less than <br />550.00 per day nor more than 5200.00 per day for each day the land has been affected. <br />Such penalties shall be assessed for not less than one day and not more than sixty days. <br />Concurrently with the issuance of such an order, the Board or the Office may seek a <br />restraining order or injunction.
