<br />5 1 A~ <br />Si.lbjec; T, 3oard ~.ppro~iai <br /> <br />Mr. Wayne Tatman, of COM, Inc., Said that he and Mrs. Gwen Fraser, his <br />sister, met with the Division on August 26, 1991, in order to discuss a <br />co-permittee application previously submitted to the Division. He said <br />that during that meeting the Division was informed of COM, Inc.'s plan <br />to purchase the Bueno Mine. Mr. Tatman said Staff informed him that <br />ore frcm other sources could be processed at the mill, as long as it <br />came from the operator's property. <br />Mr. Tatman referenced an affidavit from Mrs. Fraser, included in <br />Exhibit A, and said they had met with Staff regarding the permit and <br />was informed that as long as the operator owned the ore, specifically <br />at the Bueno Mine, it could be processed at the mill. <br />Staff clarified that Energetics, who Mr. Tatman Said owned the mill <br />complex, has a reclamation only permit covering 2 acres of the lower <br />processing area. Staff said this is the only permit active on the <br />Bueno Mine. <br />Mr. Tatman referenced EXHIBITS M and L from his package of exhibits and <br />said that Mrs. Fraser and Mr. Munn asked him to run the mill <br />operation. He said he used monzonite as a reagent and did not prccess <br />it for ore content. Mr. Tatman referenced Item 3 of his exhibits in <br />which he provides an explanation for the use of monzonite at the site. <br />Mr. Rod Helmick, the zoning administrator for Boulder County, said he <br />had been in contact with the Division and the co-permittees. He <br />clarified that the property is located in the Forestry District of <br />Boulder County which allows Sub-surface mining. Mr. Helmick said that <br />the County will not allow the inclusion of a 12 square-mile block of <br />patented and unpatented claims to be determined as affected property. <br />Therefore, the Bueno Mine was not tied to the property at Gold Hill. <br />Mr. Helmick said the County has issued a number of permits for this <br />site. He said the original permit was modified and that the <br />modification specifically stated that its use was milling as an <br />accessory to the Gold Hill properties. He said Boulder County's <br />position is that any importing of ore to the Cash Mill would constitute <br />an industrial use. He further clarified that Boulder County does not <br />have a Certificate of Designation process for a milling operator for <br />the use proposed by COM, Inc. <br />Ms. Kimberly Gent, a resident of Gold Hill, addressed the Board and <br />Stated that her concern related to custom milling at the the Cash Miii <br />and compliance with county regulations, specifically with regard to the <br />amount of traffic that would be involved in such an operation. She <br />Said Mrs. Fraser was made aware of her concerns in October of 1991. <br />Mr. C. J. Seastone, vice president of Energetics, Inc., said that <br />effective October 7, 1991, they entered into a mining lease and option <br />to purchase agreement ~,vith Homestate, Inc.
