<br />~, M ~ (~~ ^ ~p~~ <br />BEFORE THE MINED LAND RECLAMATION BOARD ejl`igia 4'wUb' <br />STATE OF COLORAD e~ ~~ ~ j ~ Mining~Rasam~~on <br />FINDINGS OF FACT, CONCLUSIONS O~AW AND ORDER <br />IN THE MATTER OF FLORENCE AND EVERET"C JACKSON'S POSSIBLE NOTICE <br />OF VIOLATION, CEASE AND DESIST ORDER, CORREC VE ACTION AND CIVIL <br />PENALTIES FOR MINING WITHOUT A PERMIT, FILE NUMBER M-2006-053 ~ <br />`~M~~-~ap(D-Q5/ <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br />August 16, 2006, in Denver, Colorado for a hearing to consider a possible notice of <br />violation, cease and desist order, corrective actions and civil penalties for mining without a <br />permit. The file number in this matter is M-2006-053. Florence and Everett Jackson <br />appeared on their own behalf ("Operator"). Chris Rowe appeared on behalf of the Division <br />of Reclamation, Minerals and Safety ("Division"). <br />The Board, having considered the parties' presentations and having been otherwise fully <br />informed of the facts in this matter, hereby enters the following findings of fact, conclusions of <br />law and order: <br />The Operator has conducted sandstone mining operations without a permit on a site located <br />in Section 3, Township 31 South, Range 54 West, 6a' Prime Meridian, in Las Animas <br />County, Colorado. The total disturbed area on the site is approximately 4.6 acres. <br />2. The Division inspected the site on July 11, 2006. The Division inspector observed that <br />dimensional sandstone had been excavated from an area estimated at 420 feet by 480 feet. <br />While no activity was taking place at the time of the inspection, the Division inspector saw <br />a generator and tractor on the site. The site appeared to be the location of historic mining <br />activity, but it appeared that a majority of mining activity had occurred recently. <br />Overburden, waste rock, woody debris and topsoil were scraped up and placed in several <br />Florence and Everett Jackson <br />M-2006-053 <br />
