On October 24, 1986, the Mined Land Reclamation Board (Board) issued a Notice
of Violation, No. M-86-068, for failure to maintain a financial warranty in
good standing as required by 34-32-117(6), C.R.S.. The Board also issued a
Cease and Desist Order with the corrective action that new financial warranty
in the amount of $6,000.00 be provided by November 14, 1986.
As of this date, November 17, 1986, that replacement financial warranty has
not been received. Therefore, as further ordered by the Board, this matter
will be scheduled in formal public hearing at the December 18-19, 1986 Board
Meeting, for failure to comply with corrective action of the Cease and Desist
Order. The Board may consider civil penalties ranging from $50.00 to
$1,000.00 for each day of violation as outlined in 34-32-124(7), or order the
permit be suspended, modified or revoked, as well as forfeiture of financial
warranty.
