M. 87102 <br />Re: Ten-Day Notice No. 87-02-107-14, Twin Pines No. 2 Mine, <br />Permit No. C-83-058 <br />Dear Mr. Hagen: <br />On December 23, 1487, the Division received a letter from your office <br />regarding the Division's response to the above referenced Ten-Day Notice. <br />Basically, the Ten-Day Notice was issued due to the fact that several <br />sedimentation ponds at the Twin Pines No. 2 Mine were not equipped with two <br />separate spillways. <br />The Division feels that there has been a misinterpretation of our response to <br />the Ten-Day Notice which needs further clarification. In the Division's <br />response it was stated that "on both ponds the principal spillway is a Finch <br />drain at the sediment storage level designed to dewater a 10 year event". <br />After a thorough review of the sedimentation pond designs incorporated in the <br />Twin Pines permit application, the staff has determined that the 6 inch drain <br />principal spillway is, in fact, situated above the designed sediment storage <br />level for both ponds. Therefore, both ponds are within compliance of <br />Section 4.05.6f3)fc) which states that "the dewaterinq device shall not be <br />located at a lower elevation than the maximum sediment storage volume". <br />Should you require further information on this issue, please feel free to <br />contact this office. <br />Sincerely, <br />Robert G.
