The violation was issued October 16, 1995. The 90 day <br />period ended January 14, 1996. Abatement requirements for the violation included <br />submitta] of a technical revision (TR), and field implementation of the designs approved in <br />the TR following final approval by DMG. The preliminary drainage channel designs for the <br />upper section of 0006-NE-2 have been submitted to the Division, and are currently under <br />review. <br />Rule 5.03.2(2)(c) list five circumstances which may qualify a surface coal mine for extension <br />of the abatement of deadline beyond 90 days. Approval of the TR following the close of <br />the 90 day period and weather conditions are two of the qualifying circumstances.
