YES Erica Crosby of the Division conducted a routine inspection at the Half Moon Pit. Field measurements were taken of the affected area boundary using a Global Positioning System (GPS) to determine if mining was taking place outside the permit area. See attached map for detail. A CEASE AND DESIST ORDER WAS NOT ISSUED TO THE OPERATOR BECAUSE: In 1979, Lake County succeeded the permit M-77-071 to affect a total of 9.9 acres. DIVISION'S REASON FOR BRINGING THIS TO THE BOARD AS MIMNG WITHOUT A PERMIT VERSUS MINING OUTSIDE THE PERMIT BOUNDARY The operator was affecting three acres outside the permit area. (DMG Policy -For any 110 type operation, if the operator affects greater than hvo acres, the operator shall be found in violation for mining without a permit. For all other permitted operations, mining without a permit shall be determined on a case-by-case basis. Items to consider include the amount of disturbance, type of disturbance, ownership of the disturbed area, impact to the surrounding area due to the disturbance, degree of any health or safety hazard).
