999 <br />V[OLATiON - FIND[NGS OF FACT <br />Pursuant to the authority vested in [he S[a[e of Colorado Mined Land Reclamation Board by C.R.S. 34-325-123, the <br />Board hereby makes the following, Findings of Fac[ at the January 2~-26, 1999 regularly scheduled Board Meeting: <br />Lake County Commissioners are conducting aSurface/I 10 gravel mining and reclamation operation, <br />Permit No. N1-71-077 in the following location: Section 7, Township I OSoutli, Rance 30West, 6th P.M. <br />2. Lake Counry Commissioners have not obtained a mining and reclamation permit for 3 acres outside the <br />pennit area, as required by C.R.S.34-32.5.-101 e[seg. <br />3. The Division of Minerals and Geology presented evidence at the Formal Public Hearing on January 26, <br />1999 demonstrating [hat: <br />Lake County Commissioners have failed [o obtain a Construction Material Reclamation Permit prior to <br />engaging in mining and reclamation activities in violation ofC.R.S. 34-32.5-109(1). The affected land <br />outside the permit boundary is approximately 3 acres. <br />DURATION OF THE VIOLATION(S) <br />The violation was discovered on October l9, 1998 and brought before the Mined Land Reclamation Board on January 26, <br />1999. The operator submitted an application for a l l2 Construction Material Reclamation Permit. The 1 12 Conversion <br />Application was submitted on January 20, 1999. <br />The Board may determine the duration of the violation by considering any of the following: <br />1. The date of the inspection that identified the potential violation(s), <br />2. When the corrective action is completed, <br />3. When did or will the activity that caused the violation(s) cease, <br />4. The date the Board ordered corrective actions will be or are completed, <br />5. The date the Board ordered corrective actions begin, <br />6. Any other relevant evidence. <br />BOARD NSTIFICATION FOR DURATION <br />1. The inspection date that identified the potential violation(s) October l5, 1998/ October 19. 1998 <br />2. The date the operator completed the corrective action (I) Filed a 1 12 aoolication on Januarv 20. 1999. <br />3. The date the activity that caused the violation(s) ceased <br />4. The date the ordered corrective actions will be or are completed See below. <br />5. The date the Board ordered corrective actions shall begin See below.. <br />6. Any other relevant evidence <br />
