E~ox 100 ) <br />Castle Rock, CO 80104 ) <br />T0: High Plains Stone Co., Scott Wagner and all other persons engaged in or <br />owning or controlling the following operation: South 40 Quarry, NE NW Section <br />14, Township 175, Range 68W, 6th P.M. Fremont County <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-124, the Board hereby makes the following <br />findings of fact: <br />1. On August 26, 1992 the Board issued Notice of Violation and Cease and <br />Desist Order M-92-057 to High Plains Stone Company. <br />2. On November 19, 1992 the Board conducted a hearing in accordance with <br />C.R.S. 24-4-101 et sec. to consider the matter of corrective actions <br />for NOV M-92-057 by High Plains Stone Company. <br />2. The Division of Minerals and Geology presented evidence at the Formal <br />Public Hearing on November 19, 1992 demonstrating that: <br />High Plains Stone Coy <br />reached an agreement <br />Stone Company to add <br />Plains Stone Company <br />Quarry to the permit <br />of mining. <br />npany and the Bureau of Land Management had <br />that should make it possible for High Plains <br />the federal lands that were disturbed by High <br />outside of the permit area of the South 40 <br />area of the South 40 Quarry for the purposes <br />
