The permittce promptly satisfied abatement steps 1 and 2 of NOV C-93-150 and <br />submitted the appropriate application to CDH for abatement of step 3 well within the <br />original abatement deadlines. Failure to abate NOV C-93-150 within 90 days has not <br />been caused by a lack of diligence or intentional delay by the permittee as stated in <br />Rute 5.03.2(2)(c). <br />2. The permittee has applied for and diligently pursued the re-issuance of the air <br />emissions permits from CDH. The air emissions permits will not be approved by <br />CDH within the abatement deadline due to the CDH review process which is, at this <br />time, beyond the control of the permittee (Rule 5.03.2(2)(c)(i)). <br />m: \oss\scm\memos2. whe <br />~_.~GC...Y:.. <br />
