Tht: Ditch Companies reviewed Lafarge <br />West, Int.'s ("Lafarge") Application for Amendment of the Shaw Pit ;Mining and Reclamation <br />Plan ("Amendment") and summit the following comments. <br />EASEMENT <br />Idaho Creek is not a natural sveam but is a carrier ditch used by the Ditch Companies and oe~ners <br />of the Carr 3c "1}•ler Ditch, the Flauck No. 2 Ditch and the Delehant Ditch to cam• irrigation water <br />from Boulder Creek to the individual ditch headgates. As a result, the Ditch Companies own a <br />prescriptive easement for the operation and maintenance of Idaho Creek as it runs through the <br />Shat+• pntpcrty. <br />The Ditch Companies' easement, which equals 130-feet-wide being 65-feet-wide on each side of <br />Idaho Creek, must remain undisturbed by Lafarge's mining operation. Lafarge must not be <br />pcrnutted to mine withtn the casement. In addition, Lafarge cannot restrict the Ditch Companies' <br />access to the casement and restrict the Ditch Companies' movement within the easement by <br />blocking access with construction materials, machinery or other items. <br />S'fABILITI' ANA!-YS[S <br />The Ditch Companies hired Teva Tech R:~fC to review the stabilin• analyses submitted by Scott, <br />Cox ~ :\ssociates, Ine. dated October 15, 2003, and August 22, 2001, to insure that Lafarge's <br />proposed mining would not, in fact, jeopazdize the stability andlor operation of Idaho Creek as a <br />carrier ditch. Please find enclosed Tetra Tech's letter dated December I, 2003, that paves <br />questions that Lafarge must be required to address prior to the llivision of Minerals and Geology <br />making a determination on whether to approve or to deny the amendment. <br />
