It was only a <br />partial plugging of the outlet and it was cleaned out in short <br />order. <br />I feel that it is important to point out the following items <br />regarding the entire situation: <br />1) Although I was aware of the culvert being partially plugged for <br />some time, the problem of access to the Rienau site has been an <br />extremely difficult issue, and one that I am not willing to <br />aggravate if I can avoid it. As you well know, last fall we were <br />both kicked off the Rienau property during the bond release <br />inspection and told not to come back until the whole situation was <br />resolved. Although we do have the legal right to perform our <br />reclamation responsibility on the site, the fact of dealing with <br />the Rienau's on the ground is not so simple. You ran into a similar <br />obstacle last fall when the Rio Blanco sheriff refused to accompany <br />you to the site and said something to the effect "he has got a gun <br />and we are not going". In all probability, no incidents would <br />occur if the State inspectors are simply walking around the site. <br />Most likely, he would simply demand that you leave. When we are <br />required to do actual work on the site, it is a slightly different <br />matter. <br />2) Enron does not intend to use the access situation as an excuse <br />for not maintaining the site.
