<br />-z- <br />1. Expiration Oate of Notice - Infdrnal Hearing at Site. If this Order <br />requires cessation of mining. expressly or in practical effect (Dot not <br />otherwise), it will expire automatically 30 days after service upon you, <br />unless, within that time, (a) an informal nearing on the cessation has been <br />Held at or near the Site, or (b) the operator has waived the holding of sucn <br />a neartnq. The informal nearing will be presided over oy representatives of <br />the Division otner than Che representative ~+ho issued the Order. Temporary <br />relief from the Order nay oe requested at such hearing. Your right to a <br />formal review is not affected oy any waiver on your part of an infornal <br />hearing. <br />2. Formal Review and Tem arar Relief. The Operator has the legal right to <br />a review or this roer or vio anon to a formal public hearing oefore the <br />Colorado Mined Land Reclamation Boaro. You may apply for review by submitting <br />an Application far Review within 90 days of the issuance of tnis Order. The <br />Application for Review must ue suomitted to: - <br />Mined Lana Reclamation Board <br />1313 Sherman Street, Roam 423 <br />Oenver, Colorado 30203 <br />If you request a formal hearing, you may request temporary relief from tnis <br />Order, pending nearing, but the filing of a request for review ddes not <br />operate_as a stayy cf an Order or ~rocice. Procedures in this regard are fountl <br />in C.ii.~. 1973, 34-33-124. <br />3. Mandatory Minimum Penalties. C.~i.S. 1913, 34-33-123(d)(1) requires that <br />a~nandatory minimum penalty df 5150.00 or more must oe d552552d fdr earn day <br />during wnicn cne violation(s) continues oeyond the aoac2~nenc period set forth <br />in tnis order or in any ~votice of 'lidlation. <br />If you willfully and knowingly fail or refuse to comply with this Order, you <br />will oe suoject to cri,ninal prosecution and will, upon conviction, oe punisned <br />oy a fine of not more tnan 310,000.UO or oy imprisonment for not mare than one <br />year, Or botn. <br />4. Effect on Permit. In addition, if it is determined cnac a pattern df <br />violations exists, and cnat Che violations Nere caused oy unwarranted failure <br />to cd~mply, or were willful, your permit may oe suspended dr revoked. <br />
