The Tenant shall pay, before delinquent, all <br />charges for electricity and other utility services used, rendered, <br />or supplied for the operation of the Tower and Building. Upon <br />request of the Tenant, the Landlord agrees to grant to Poudre <br />Valley Rural Electric Association or other utility provider a <br />nonexclusive utility easement from County Road 23 to the Tower <br />Location for the construction, installation, maintenance, repair, <br />and replacement of electric lines adequate to serve the Tower and <br />Building. The exact location oP the utility easement shall be <br />reasonably determined by mutual agreement of the parties. <br />7. IIse of Premises. The Tenant may use the Leased Premises <br />for the construction and operation of the Tower and Building and no <br />other purpose without the consent of the Landlord. If the Tenant <br />desires to grant to other entities the right to use the Tower for <br />radio, cellular phone, or other purposes, the Tenant shall pay to <br />the Landlord one-half of all rent received by the Tenant as a <br />result of such use. The Landlord shall not be obligated to pay any <br />costs which may be incurred to upgrade the Tower to accommodate use <br />of the Tower by any such third party. <br />8. Trash Disnoeal. The Tenant shall not burn or incinerate <br />any rubbish, garbage, or debris at, in, or about the Property and <br />shall not permit any rubbish, garbage, or debris to accumulate <br />thereon. <br />9. Ordinances. In the construction and operation of the <br />Tower and Building on the Leased Premises, the Tenant shall observe <br />and comply with ail laws, ordinances, anQ regulations of public <br />authorities having jurisdiction over the Property. <br />10. Installatio and Maintenance_of Imtrovements, <br />(a) The Tenant may install upon the Leased Premises the <br />Tower, not to exceed five hundred (500) feat in height; guy wires <br />and anchors; the Building, not to exceed two thousand five hundred <br />(2,500) square .feat in size; a Pence around the Tower, Building, <br />and anchor points, which fence may be chain link, eight (8) feet in <br />height with barbed wire on top; and such toilet facilities as may <br />be required by any governmental authority having jurisdiction over <br />the Leased Premises. <br />(b) The Tenant shall paint the Building a neutral or <br />earthtone color. The Tenant shall maintain the Building and other <br />improvements in good condition throughout the term of this Lease. <br />(cj The Tenant may Install such fixtures and equipment <br />within the Building as necessary for operation of the Tower. Prior <br />to the termination of this Lease, all improvements installed by the <br />4 <br />
