-2-
November 23, 1982
Mr. Dave Shelton
within the scope of our November 5 exploration approval
particularly in view of the nature and size ofdisturbance
and the substantial bond coverage.
4ie should point out that NOV 82-54 makes no reference whatsoever to the
approved exploration program. We are, therefore, unclear as to whether the
inspector was fully knowledgeable of the permitted status of the activity.
On the basis of the facts set forth above, we respectfully request that the
Civision vacate ~JDV 82-59. lr'e understand that the presentation of these
facts and request will, in no way, affect our right to have a formal appeal
procedure before the Mined Land Reclamation Board at some future date.
As you know, Dorchester has idled the current operation and is in the process
of engineering and permitting a larger operation at the site. Therefore,
the present situation regarding applicable permits and their interpretation
with the engineering and exploration approvals is complicated and confusing.
We would suggest that an informal meeting would be a much more appropriate
setting in which to discuss and resolve any questions you, or your people,
might have concerning our current activities and future plans for the Fruita
property.
Please let us know when you, or your staff, can get together with us. Thank
you.
Sincerel
~`°'r
Dean R. Ma
Director - Govern nt irs
DRM:D
