~~' „ Flow initiated outside the permit area and was not as a result of any actions by the operator but, rather,
the flow occurred because of melting snow, heavy rains coupled wi[h a few buried rotting aspen trees.
However, since the mud flow caused a small disturbance in the southwest corner of the permit area, the
operator was ordered to submit a well developed, engineered plan to prevent further migration of the
mud slide (see documents 11, 12 and 13).
The operator submitted a plan to the Division on November 7, [996 (documents 14 and 15). The plan
was acceptable to the Division.
[n conclusion, a mud slide did occur near the site, the Board did not find a violation of [he Ac[ and/or
the Rules and Regulations and the operator complied with all Board requirements.
If you have any other questions, please give me a call.
Sincerely,
,~ ~~
t`. ,p~,,.~w~-
~lames Dillie
Environmental Protection Specialist
Enclosures
