r • III IIIIIIIIIIIIIIII <br />999 <br />Item # ~z <br />PERMITTED 112 OPERATION <br />General Information: Bromley Laken Pit <br />Date: March 30, 1995 Commodity: Sand & Gravel <br />File No.: M-87-049 Acreage: 389 <br />Operator: Ready Mixed concrete Specialist: Gary Curt ies <br />Location: Adams County, aec.ll-14 Existing Bond: S125,25O.OO <br />T1S, R67W, 6th PH Corporate Surety <br />Nature of Violation: <br />The operator met with the Division on February 13, 1995 and reported they <br />had discovered that a portion of the northeastern corner of the operation <br />was outside the permit area. Mr. Bill Timmons stated that the problem <br />was discovered ae a result of a recent survey of the permit boundary. <br />The purpose of the meeting was to report this oversight and initiate <br />corrective actions. <br />The area disturbed outside the permit included a portion of a water <br />filled pit which had been previously mined and reclaimed. Current mining <br />activities are being conducted within the present permit area. According <br />to the operator, the total disturbance outside the permit area ie <br />approximately 11 acres. <br />Duration: From 2/13/95 to 3/30/95 = 45 days <br />Seriousness: Zones <br />D C B A <br />(A) Administrative Violation, or Some On-Site Damage <br />(B) Little Off-Site Damage, Moderate On-Site Damage, No Health or <br />Safety Hazard <br />(C) Little off-Site Damage, Significant On-Site Damage, and/or <br />~POSSible Health or Safety Hazard <br />(D) Off-Site Damage, and/or Significant Health or Safety Hazard <br />History of Violations in Paet Twelve Months: None <br />Staff Recommendation: <br />Violation: Find a violation of C.R.S. 34-32-116 (7) (h) and <br />Rule 3.1.5(3) for failure to protect areas <br />outside the permit area and/or C.R.S. 34-32- <br />109(1) and (2) for mining without a permit. <br />Cease and Deaiet: Recommended for mining activities in areas <br />outside the present permit area. <br />Corrective Actions: <br />1.) File no later than June 5, 1995, a complete amendment to the <br />permit to include all areas presently disturbed and all areas <br />necessary to achieve reclamation. <br />2.) Obtain an approved amendment no later than October 5, 1995 if <br />there are no objectors. <br />Civil Peaaltp Range $100 - $ 950 per day ($1,000 - 55,000 per day for <br />mining without a permit).
