-~- <br />state all owners of the affected land and the substance to be <br />mined and failure to provide proof of a legal right to enter <br />and initiate a mining operation on the property in question. <br />The operator mined an area outside his permit boundary and <br />subsequently trespassed on land which is owned by the Forest <br />Service. <br />The operator has attempted to resolve this matter by <br />submitting an application to the Forest Service which, if <br />approved, would allow him to use Forest Service land or enter <br />the property to conduct reclamation. <br />The Division contacted the Forest Service and determined that <br />they have not responded to the operator's request. Staff said <br />the Forest Service indicated that they would address the <br />operator's permit application, after a trespass issue has been <br />resolved. Staff said the Forest Service could not provide a <br />time frame when the matter would be addressed. <br />The Board changed the corrective action in this case, <br />requiring the operator to continue to pursue, with all <br />possible vigor, the obtaining of the necessary Forest Service <br />and Corps of Engineers permits and to report back to the Board <br />within 30 days of the time that these are obtained, so that <br />any further, necessary corrective action, including the <br />assessment of civil penalties, could be taken be the Hoard. <br />19. FORMAL PUBLIC HEARING <br />GOLDEN RULE RESOURCES, INCORPORATED File No. M-93-045 <br />Larry Lahusen <br />Consideration of a possible notice of violation, cease and <br />desist order, corrective actions and civil penalties for <br />mining or prospecting without a permit. <br />Investigations into a complaint indicated that mining <br />operations that occurred at the site were probably pre-law. <br />Prospecting operations were conducted at the site as late as <br />March of 1982. <br />Mr. Larry Lahusen, representing the operator, and Mark Fuller, <br />representing Pitkin County, were present during the hearing. <br />They addressed the Board and answered questions, regarding <br />this matter. <br />The Board found that a violation had occurred of conducting <br />prospecting operations without an approved Notice of Intent. <br />The Board followed the Staff's recommendations and required <br />the operator to either show proof, through documentation, that <br />all drill holes and other disturbances were properly sealed <br />and safeguarded or apply for a prospect permit that would <br />ensure the safeguarding of the site, if the information cannot <br />
