NOTICE OF VIOLATION

Based upon these same Findings of Fact and in accordance with
C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Board hereby finds
Telluride Gravel, Inc. to be in violation of Permit M-76-032, and
C.R.S. 34-32-112(2)(b), 34-32-112(2)(c) AND 34-32-112(2)(d).
CEASE AND DESIST ORDER
Based upon these same Findings of Fact and Notice of Violation, and in
accordance with C.R.S. 34-32-124(2),(6) and (7) the Colorado Mined Land
Reclamation Board hereby orders Telluride Gravel, Inc. to:
Cease and desist from conducting mining or related operations on
U.S. Forest Service land within the permit area of Permit M-76-032 until
right of entry to those lands has been secured.
2. Mail, within one (1) day after receipt of this Notice, to the
Mined Land Reclamation Board, written notice of your compliance with
paragraph one (1) of this Cease and Desist Order.
3. Complete the following corrective action:
a. Secure right of entry to Forest Service lands within the permit area
which have been disturbed by the operation and submit evidence of
this to the Division in the form of a proposed Technical Revision to
the permit. If the right to mine will not be obtained, submit a
Technical Revision to the permit which provides right of entry to
Forest Service lands for reclamation purposes, modifies the
reclamation plan to meet Forest Service requirements, and commits
the operator to commence immediate reclamation of the disturbed
Forest Service lands. Submittal of either Technical Revision should
be made as soon as possible but no later than July 1, 1993 and
approved by August 24, 1993.
4. The matter of the civil penalty relating to Notice of Violation M-93-017
will be continued until the August 25-26, 1993 meeting of the Board.
This Cease and Desist Order shall remain in effect until all terms have been
satisfied by the operator.
