If the Board :f Regents approve the <br /> Women of the West lease at the Research Park, the Third <br /> Amendment eliminates the obligation of the University to <br /> accept conveyance of the Property subject to the Women of <br /> the West ground lease. <br /> m. Parkino at Distribution Center. The University will <br /> construct additional parking at the Distribution Center <br /> in accordance with the Contract. fellers have approved <br /> the plan for such additional parking. <br /> C. Distribution Center Lease. The University, as tenant, <br /> and Quin H and Cottonwood, as lar- ' :I, are in agreement <br /> as to the provisions of a lease back of the Distribution <br /> Center. The essential provisions :: the lease will be a <br /> 44-1/2 month initial term after the date of closing (but <br /> the tenancy shall not commence un_:1 the Exchange Date) , <br /> with no base rent, but with the University being <br /> responsible for maintenance and insuring of the building. <br /> The landlord will pay all real property taxes which may <br /> become due after the Exchange Date. The University will <br /> have an option to extend the lease for an additional 30 <br /> months at a fair market rental value. <br /> D. warehouse Lease. The University will take title to the <br /> Property subject to a lease of the warehouse to the <br /> tenant who currently operates a tennis facility in the <br /> building. The lease must be on a month-to-month basis, <br /> provide for monthly rental of $1650 plus utility <br /> expenses, and be terminable at any time after April 1, <br /> 1997 upon 30 days prior written notice. <br /> E. Reclamation Plan Revisions. Sellers and Buyer have <br /> agreed upon revised reclamation plans in accordance with <br /> the Contract requirements. The T`:rd Amendment provides <br /> for Sellers to be responsible after :losing for obtaining <br /> approval of the reclamation plan revisions for the Damps <br /> Farm Pit and Turnpike Pit, in cooperation with Western <br /> Mobile, Inc. as to the Deep& Farm Pit and flatirons Sand <br /> i Gravel Company as to the Turnpike Pit. <br /> F. morn Certification and Flood Plain Remaneing.
