f t <br />Comments: The Hallenbeck gravel pit has been mined <br />since the late 1940's by the State of Colorado to con- <br />struct Highway 65 generally in the Grand Mesa area. The <br />County of Delta has mined in this gravel pit and Clyde <br />Hallenbeck applied for the present permit #M'77-062. <br />Because the Town of Orchard City Office borders this <br />gravel pit the retired City Manager Wes England can <br />verify most of the pre-disturbed areas. It is apparent <br />that Benson Brothers have mined in violation of the per- <br />mit #M-77-062 but cannot be held completely liable for <br />all the disturbed areas. Since our ownership in March <br />of 1984 Benson Brothers have reclaimed back to the <br />scheme of locale the south hill in which one of the pre- <br />vious owners dumped rip rap and unsightly boulders. <br />Benson Brothers thought that they had been mining re- <br />sponsibly to the neighbors that surround us and to the <br />environment that they will some day leave behind, it <br />would prove somewhat our honesty to the Board to reflect <br />on our past Anniversary Annual Reports that we had <br />thought by following the previous mining areas that we <br />were in compliance with the permit even though they show <br />that we had mined out of the permit area. <br />Enclosed is an aerial photo of the gravel pit. We feel <br />that this photo reveals to the Board the elements that <br />we have discussed; <br />1. (Silver Building) Town of Orchard City Office <br />2.
