Dept. of Neiural Resouccc~ <br />As a follow-up to the assessment conference held in <br />relation to the Mine Land Reclamation Division Notice of Violation <br />on August 26, 1986, we continue to believe it preferable that this <br />matter be settled jointly among Snowmass Coal Company and both of <br />your Divisions. The pursuit of both notices of violation and a <br />determination of the complicated legal issues raised would involve <br />unproductive time and expense for all parties. Snowmass, therefore, <br />proposes that the NOVs be resolved in a manner acceptable to all <br />parties and that Snowmass's future responsibilities be included in <br />the resolution as well. <br />The terms and conditions to which Snowmass would be willing <br />to agree are the following: <br />(a) The Mined Land Reclamation Division issued its Notice <br />of Violation No. C-86-OS1 on June 17, 1986, alleging that certain <br />conditions in May of 1986 constituted a violation under MLRD's <br />jurisdiction, and issued a related Notice of Proposed Amount of <br />Civil Penalty on July 1S, 1986. <br />
