At this point the Estate <br />• 2 has taken on the responsibility and again we're not <br /> 3 going to play these legal games that tae could be playing <br /> 4 for five years. We have taken on the responsibilities <br /> 5 as representatives of the Estate to pay the $5,000. We <br /> 6 ha~.~e not gone to the other heirs to do that. I would <br /> 7 presume that at the time of bonding, the Estate may take <br /> 8 on that responsibility, but that decision has not been <br /> 9 made at this point and it will be subject to discussion <br /> 10 again when we come up in January for a review of the <br /> 11 permit application. I have to say it is a question, <br /> 12 Mark, at this time. Perhaps by that time, we caould have <br /> 13 some decision from the District Court. At this point <br /> 14 we can't state categorically who will be doing it. <br /> 15 MR. HOLDER: Thank you. <br /> 16 MR. F]ATSON: One point of clarification if <br /> 17 I may too. It was not included in Mr. Barry's motion <br /> 18 and I am presumi/Zg that his statement of suspension <br /> 19 means contingent on receipt of the permit. He didn't <br /> 20 mention that, but within a 130 day period that Mark had <br /> 21 mentioned, is that still -- <br /> 22 h1R. LOYE: I mentioned 150 days. <br /> 23 MR.
