Fattor.
i1 R. COSGRIFF: I would like to make a few
brief comments. Pete Cosgriff is my name. I represent
Charles Webster who is one of the claimants to the
Webster Sand and Gravel business and the west Tennessee
Pass pit in particular. As the board will recall, we
were here last month and in connection with the Jones
pit at that time, I think you also considered the question
of the West Tennessee Pass pit at least as far as its
location and nature of operation. At that time ore
related to the board that we would have before you by
November 1, completed permit applications for both pits
and that has been done and the application fees have
been paid.
At that time you assessed a $10,000 fine
on the Jones pit, suspended five and we have paid'the
$5,000. With respect to the assessment of a fine at
this time on the West Tennessee Pass pit, I would like
to comment first that there has been no mining as you
have defined it on that pit since the demise of htr.
Webster. At that time he appeared before you on January
28th, 1981 and he was advised that he was in violation
of his Jones Pass operation and by reason of that
knowledge, he ceased all operations and his heirs did
thereafter of any mining operation on those tcoo pits other
r.llr~t:~ r~wrrcrel+s ~i.u~o<~l.-irca.l~~c
(,~rnf nl Sh~whanJ R, /runrv,
lSUO Ch,~rri ~~,L.
