~ ~ III IIIlilllllllllll <br />MINUTES <br />MINED LAND RECLAMATION BOARD MEETING <br />June 10, 1980 <br />After Sunshine Notice on June 9, 1980, the t4ined Land Reclamation Board, <br />at its meeting to consider Coal Regulations, was called to order at <br />2:00 p.m. on June 10 to consider Board action regarding Weld County <br />for operating without a permit and operating in violation of a previous <br />Board ordered Cease and Desist issued on June 28, 1978. <br />BOARD MEMBERS PRESENT: Bob Turner, Vice-Chairman, Larry Brown <br />Sherman Blach and Hamlet J. Barry, III <br />STAFF MEMBERS PRESENT: Brad Janes, Reclamation Specialist <br />Mark Loye, Reclamation Specialist <br />Dave Shelton, Supervising Reclamation Specialist <br />Diana Heyer, Recorder <br />Dave Shelton introduced to the Board the problems involved with the Weld <br />County sand and gravel operation located on the St. Vrain east of I-25, and <br />outlined what he thought the alternatives open to the Board might be: <br />a) consider a court injunction, b) issue additional specific cease and desist <br />order, and/or c) set a hearing to consider civil penalty. <br />Staff presentation was made by Brad Janes, indicating that he and Jim Schmieding, <br />of the Division staff, had made an inspection of the site on April 23 and <br />explained the activities that had taken place there. Staff indicated that <br />no application has been received by the Division nor is the operation under <br />permit. <br />Ptr. John Slovac, a Weld County Citizen, who is an adjacent landowner presented <br />testimony in objection to the operation. <br />Mr. Tom David, Weld County Attorney, and Mr. Wayne Smith, Weld County Engineer, <br />were asked to respond as to why an application has not been submitted for the <br />operation. <br />It was PtOVED that the Board find Weld County in violation of mining without <br />a permit and in violation of operating against a cease and desist order, <br />and that a hearing be set for determination of civil penalty at the July <br />regular board meeting, and that the Board direct the Attorney General to <br />immediately initiate injunction proceedings against Weld County to stop all <br />mining in this gravel pit and on all other mining operations under their <br />direction, and that this circumstance falls under Section 120 of the statute <br />as did E1 Paso Couty.
