Lnc nneaa <br /> Eaeculive Director <br /> Michael B Long <br /> Division Director <br />Re: Extension of Abatement Time for Rimrock Mine, <br />Permit No. C-89-074, NOV C-95-015. <br />I find that the request to extend the abatement date, beyond the 90 day time period, for <br />NOV C-95-015 for the Rimrock Mine is reasonable for the following reasons: <br />The abatement required by the Division is for the permit to be transferred to a valid <br />permittee. <br />The permittee applied for a transfer of the permit on May 31, 1995, nine days following the <br />issuance of the NOV. <br />The permittee has provided all information requested by the Division, for review of the <br />transfer. The inhibiting factor for the Division to approve the transfer is an AVS block on <br />the operator. The operator has appealed the reasons for the AVS block with the State <br />Regulatory Agency that entered it into the AVS. <br />This appeal is not planned to be heard by the State Regulatory Agency until October, 1995. <br />The Division is awaiting outcome of this appeal to determine the decision regarding the <br />transfer of the permit. Therefore, Rule 5.03.2(2)(c)(i) applies in this case. <br />c: \jhb\C89074\C95015. ML <br />
