Colorado 81641 <br />1303182a-aa51 <br />n,... <br />~~ '•,, <br />~U( 22 1994 <br />n,t,.V.,L, C. <br />,.ru. <br />„ ~..~ <br />,,, j <br />The purpose of this letter is to provide the Division with <br />additional information regarding the referenced NOV and to provide <br />a response to the Division's "Civil Penalty Worksheet" dated June <br />16, 1994. <br />• The initial inspection report of May 27, 1994 noted that <br />the subject ditch was to be constructed prior to the end <br />of the inspection. A casual reading of the report would <br />leave the false impression that the lack of sediment <br />control was a complete oversight by Colowyo and <br />absolutely no effort had been initiated to correct the <br />situation. Prior to the DMG inspection this oversight <br />had, in fact, been recognized by Colowyo, and a dozer had <br />been mobilized to the site and operators were on the <br />ground beginning the initial survey for the ditch. A <br />plan was clearly in place to correct our oversight <br />independent of the DMG inspection. <br />• Ditch construction was rapidly completed within 24 hours <br />of the Division's observations. The ditch construction <br />was completed extraordinarily fast because Colowyo had <br />recognized the oversight well before being noticed by the <br />Division and had already mobilized equipment to the area. <br />Colowyo's rapid response was instrumental in preventing <br />any potential offsite environmental harm. <br />• The NOV states that there was a "failure to pass <br />disturbed drainage through a sedimentation pond or <br />treatment facility before leaving the permit area". <br />Since there was no storm event or other source of runoff <br />occurring prior to construction of the ditch, this <br />statement is incorrect. There. was, in fact, no <br />disturbance drainage therefore no resultant environmental <br />damage. <br />
