_2_ <br />CORRECTIVE ACTIONS <br />1. Require the operator to submit a complete conversion application, converting the <br />Limited Impact 110 permit to a Construction Material 112 Extraction permit by October <br />27. 1996 and receive approval of the conversion application by January 25, 1997. <br />2. Require the operaror and/or landovdtter to post an interim reclamation bond in an <br />amount to be negotiated b the operator and the Division for backfilling the water <br />impoundments by .September 22. 1996. <br />3. <br />4. <br />CIVIL PENALTY (C.R.S. 34-32.5-123) <br />1. Require the operator and/or landowner to pay a minimum civil penalty in the amount of <br />$ 532.80, based on 16.0 hours of staff time at $33.30 f hour. <br />2. If the Board finds the operation to be an illegal Construction Material Extraction <br />Operation, the Board should also assess the operator and/or landowner a civil penalty of <br />not less than $1,00(1.00 per day nor more than $5,000.00 per day for each day the land <br />has been affected, not to exceed 365 days. <br />a. In this case, the Office recommends that the Board find 47 days of <br />violation at $ 1.000.00 per day. <br />b. The total civil penalty of $ 47.532.80 (Nos. 1 & 2) is due 30 days from the <br />date of the signed Board Order. <br />c. The Office recommends that a portion of the total civil penalty be <br />suspended, if corrective actions are completed by the required dates and <br />the interim bond is posted by September 22. ]996. <br />3. If the Board finds the operation to be an illegal Construction Material Exploration <br />Operation, the Board should also assess the operator and/or landowner a civil penalty of <br />not less than $50.00 per day nor more than $200.00 per day for each day the land has <br />been affected, not to exceed 60 days. <br />a. In this case the Office recommends that the Board find days of <br />violation at $ per day. <br />b. The total civil penalty of $ (Nos. 1 & 3) is due 30 days <br />from the date of the signed Board Order. <br />c.
