- - <br />RE-ENTER GAMBIT, INC. <br />Satisfaction was expressed over the status of all County <br />operations at a meeting with Gambit, Inc. on 2/25/91. It <br />was felt that the CMLRD Technical Revision approval and low <br />level of poncern expressed by the CMLRD staff did not en- <br />tail the need for any further outside assistance. <br />Gambit, Inc. was invited to re-examine the Fondis Mine on <br />4/29/91 based upon correspondence from adjacent landowner, <br />James R. Taylor, that the site was associated in some man- <br />ner to damage of his property. Gambit, Inc. was subse- <br />quently retained on 5/6/91, and effective 5/1/91 per the <br />4/29/91 agreement. <br />An inspection by Gambit, Inc. of the Fondis Mine occurred <br />on 5/6/91 to review current conditions and problems, and <br />determine probable boundaries to expansion of the mine. <br />Expansion of the operation was deemed vital since the site <br />provides a significant aggregate resource for Elbert <br />County. Plans for corrective action of existing problems <br />were to be incorporated as part of the plans for site ex- <br />pansion. <br />THE 6 MAY 1991 INSPECTION: <br />The observations made at the site at this time indicated <br />that three 60 inch culverts were in place at the access <br />road over Spring Branch. Performance of design specifica- <br />tions was not determined at the time of the inspection. <br />The access road remained "perched" and still an obviously <br />eroding and the significant contributor of sediment to <br />Spring Branch. The west berm (unvegetated) was in place <br />and the mine area drainage was largely contained with some <br />lateral exceptions, including drainage along the east side <br />of the perched access road. A slight berm to the east of <br />the site above the cut slope was evident, however, due to <br />the fact that there was no upslope watershed, its value was <br />marginal to none, though required in the permit. Pit <br />slopes were close to 4h:ly, but could not be confirmed <br />without a survey or further analysis. Sediments from the <br />1990 hydrological event were being invaded by vegetation, <br />but no investigation of cover was made at that time. <br />Permit documents and related correspondence was not avail- <br />able to Gambit, Inc, at the time of the inspection, yet in <br />retrospect, the required rip rap was not in place or stock- <br />piled for use at the site at the time of the inspection. <br />Of greatest significance was the blading of material into <br />Spring Branch during the construction of the west berm. <br />Correspondence of 6/15/91 to Frank G.
