U. 5. 24 <br />Green Mountain Fa11s, Colorado 80819 <br />RE: Gravel operation near Green Mountain Fa11s <br />Dear Mr. Houchin: <br />After our site inspection Friday, December 5. 1980 and subsequent search of the <br />tiles fora mining and reclamation permit, we can find rtothing in our records to <br />indicate that you have applied for or obtained a permit from the Mined Land <br />Reclamation Board. <br />A11 mining operators (including sand and gravel operation) are required by <br />statute to obtain mining and reclamation permits for their mining operations 1n <br />Colorado per the Colorado Ptined Land Reclamation Act Article 32 of Title 34, <br />C.R.S. 1973. as amended (1976 Sess. Laws --H.B. I065f. <br />I am obligated to bring your operation to the attention of the Board during <br />their December 17-18, 1980 meeting. As it now stands, there are two possible <br />situations which may occur: <br />1. You may voluntarily cease operations lmmed~iately and apply for <br />a permit, 1n which case I will recomnen~that consideration of <br />possible civil penalties be deterred. <br />2. Or, the Board will meet to consider this issue as a possible <br />violation, and, if you continue to mfne after receipt of this <br />letter, for the consideration of a hearing for possible assess- <br />ment of civil penalties. The magnitude of such penalties may <br />be Pound in Section 34-32-123(2), pagt 13. of the "Act". <br />Enclosed you will find an application(s) for this operation. Obviously. tt will <br />be 1n yaur best interest. and ours. to apply soon. Your operation will probably <br />be considered a limited impact operation. The beck of the application states <br />additional information that must be addressed. The "green" Rules and Regulations <br />booklet you have gives guidelines for this information as well. <br />If we can be of assistance to you with this matter. please write this office or <br />salt us at 839-3567.
