Long <br />Drvrsion Director <br />In response to Basin Resources' request to vacate NOV C-93-011, <br />received at the Division on November 3, 1993, on the grounds that <br />this NOV was duplicated by Federal NOV 93-020-352-003, it was <br />discovered that the state NOV and the federal NOV are not the <br />same. The federal NOV concerns four sedimentation ponds whereas <br />the state NOV dealt with five sedimentation ponds. Therefore, it <br />would be inappropriate to vacate NOV C-93-011. <br />Therefore, the Division is requesting that Basin Resources' <br />request a second assessment conference to deal with one <br />sedimentation pond, RDA-north, in NOV C-93-011. <br />If you have any questions, please call me. <br />Sincerely, <br />D <br />oseph J.
