In a
conversation with Dan Hernandez today, he informed me of the nature of the violations,
the likelihood of their modification, the remedial measures necessary to abate each
violation, and the abatement deadlines.
Given the proposed modifications to the remedial measures for the notices of violation
and my recent retention to address the issues associated with the notices, I would
respectfully request an extension to the abatement deadlines for each of the notices of
violation
For NOV CV 2000-002, issued for failure to provide a valid certificate of insurance for
the mine, I would request an extension to June 15, 2000. Dan Hernandez and I discussed
the apparent confusion regarding the mailing address the insurance company has, the
necessity to modify the language on the insurance binder to satisfy CDMG requirements,
and the requirement for a valid signature. I plan to contact the agent you have been
dealing with in the next several days to rectify these concerns. As I will be out of the
office next week, and the agent is not in Colorado, I anticipate the need for additional
time to produce the required document. It is my understanding that the mine has not been
without liability insurance coverage, but that documentation is not present and sufficient.
I will obtain that documentation and provide it to CDMG by June 15, 2000 if that
extension date is acceptable.
NOV CV 2000-003 was issued for failure to maintain copies of records and reports. If
acceptable to the Division, I would request an extension of the abatement deadline to July
10, 2000 (90 days from issuance of the NOV). As you aze aware, some of the requested
information may not be available, and I need to determine that which is and that which is
not. I will also need some time to prepaze the requested annual reclamation report and
annual hydrologic report. I am also in the process of updating the required records and
