Sanchez and Espinoza:
I have been instructed to continue sending a monthly report regarding receipt of he required lab
reports for all the monitoring stations in and around the tailings impoundment (i eludes DW-2,
D87-24, M-11R and SF-1 near the West Pit) and all of the RS surface stations ( S-1, RS-2, RS-
3, RS-4, RS-5 and RS-6).
There seems to be some confusion concerning what the DMG sends. Your letter) states that
monthly lab reports that BMRI submits to the DMG are forwarded to CCCD. T is is incorrect.
BMRI submits lab reports for various monitoring stations (including those note above) to the
DMG but those reports are not automatically forwarded to CCCD..Only a moot ]y report
ackowledging receipt oF"the lab reports was sent to the CCCD. If the CCCD w ted copies of the
lab reports, they submitted a specific request for copies.
I was also instructed to find out who the monthly report should go to. In 1995, t e Board
identified Nora Jacquez as the recipient of the report. However, in 1998, Ms. ]a quez informed
the Division, by phone, that she no longer representated CCCD and that she no I nger wanted to
receive the report. She recommended sending the report to Mr. Maclovio Marti z. The Division
began sending the report to Mr. Martinez in February, 1999. The DMG is askin~ you and Mr.
Maclovio Martinez (CCCD) to please indentify one individual, or one entity, w o should receive
the monthly report. Please provide the name and address of this person or entity.'i Ms. Lori Potter
said to send the monthly report to Costilla County Planning and Zoning (letter dated March 22,
2001 to Mike Long). If this meets with your approval, and CCCD's approval, th~ Division will
begin sending the report to the CCPZ in April or May.
Also, you have requested that BMRI's monitoring activities be sent to you. Sind they aze public
documents, you may ask for copies of any and all lab reports, or any other docur~tent for that
matter. Generally, the Division sends them out to be duplicated. The company tHat duplicates
them will contact you each and every time you submit your request to confirm the order (if you
