C-93-025 and C-93-026
Ms. Susan L. Burgmaier
Colorado Division of Minerals and Geology
1313 Sherman Street, Rm # 215
Denver, CO 80203
Dear iVis. Bm'gnmier:
This letter serves as a written request for an extension to the abatement date of October 2, 1993 for
the above referenced NOVs. P&M requests a 60 day extension to December 1, 1993 for abatement
of all three of the Notices of Violations.
Rule 5.0.2 of the Regulations of the Colorado Mined Land Reclamation Boatel for Coal Mining
allows for extensions to be granted of up to 90 days on abatement deadlines. These extensions are
needed to allow time for continued development of structure designs, regulatory processing and
field work following approvals of Technical Revisions 24 and 25.
Technical Revision 24 was initially submitted to CDMG under cover letter, dated May 14, 1993.
P&M received a precursory review letter on June 16, 1993 expressing several concerns by the
Division. The revision was resubmitted to the Division on September 10, 1993 addressing the
concerns expressed by the Division in the June 16, 1993 letter. P&M received an additional
adequacy letter (via fax) on September 16, 1993 expressing additional concerns relating to
Revision 24. Due to the technical complexity of the recent concerns expressed by the Division,
P&M is requesting the extension to provide time for development of the additional designs
requested, regulatory approval of those designs and implementation of the field work.
Technical Revision 25 was initially submitted to CDMG under cover letter, dated May 20, 1993.
Additional revised information to the revision was submitted to the CDMG on August 9, 1993.
P&M received adequacy review lettets from CDMG, dated August 17, 1993 and August 24, 1993
expressing concerns regarding the design information included in Revision 25. Due to the
technical complexity of the concerns expressed by the Division, P&M is requesting an extension to
provide time for the redesign of the structures, regulatory approval of the revised designs and
implementation of the field work.
Should you have any questions regazding this matter, please contact David Beverlin at the Edna
Mine.
Sincerely,
~~-Q~~~
Brian D.
