Just a note to let you know that yesterday, I spoke with Bill Atkinson, the DOW aquatic biologist who <br />last month inspected the Foidel Creek coal fines spill. I asked Bill where DOW was with regard to their review of <br />TCC's Minor Revision MR-211 (the revision proposing a plan to clean up the spill). Bill referred me to Justin <br />Pollock, the DOW District Wildlife Manager in the Steamboat Springs office. I called Justin yesterday and left a <br />phone mail message, asking him to contact me. <br />Justin called me this morning. He said that he and Bill have spoken about the clean up plan, but that they have <br />yet to formalize their concurrence. I asked Justin if we could forward the MR to him, so that he could take a look <br />at it and work with Bill on the review. He said OK. As documented below, Byron forwarded the attached section <br />from MR-211 to Justin about forty-five minutes ago (this in addition to your a-mail from last month transmitting the <br />same attachment to Bill). Hopefully, DOW will provide their comments to us soon. <br />We still have not heard anything from Nathan Green with the US Army Corps of Engineers regarding his review of <br />MR-211.
