! ~ <br />-2- <br />CEASE AND DESIST ORDER <br />Based upon these same Findings of Fact and Notice of Violation, and in accordance with C.R.S. <br />34-32-124, the Colorado Mined Land Reclamation Board hereby orders Walker Mining & Milling, <br />Inc., to: <br />1 . Cease and desist from conducting further mining and/or milling activities at the Ruby <br />Trust Mine, Permit M-79-181, except for reclamation activities and site maintenance, <br />until the operator completes the corrective actions listed under paragraph three 131 <br />below. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land Reclamation <br />Board, written notice of your compliance with paragraph one 111 of this Cease and Desist <br />Order. <br />3. Complete the following corrective actions by April 30, 1998: <br />a. Increase the financial warranty to not less than 59,481. <br />4. Pay the Colorado Mined Land Reclamation Board a civil penalty in the amount of 53,800, <br />within 30 days of the signature date of this document. However, the Board agreed to <br />waive all but 5800 of the 53,800 civil penalty providing that Walker Mining & Milling, <br />Inc., comply with the Board ordered corrective actions. <br />This Cease and Desist Order shall remain. in effect until all terms have been satisfied by the <br />operator and surface owner. <br />In clarification of the rights of recipients of Notices of Violation, Cease and Desist Orders, <br />parties are advised to consult the Colorado Mined Land Reclamation Act and the State <br />Administrative Procedures Act. <br />Nothing herein contained, particularly those portions requiring certain acts to be performed <br />within a certain time, shall be construed as a permit or license to engage in any prospecting or <br />mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are advised to consult <br />C.R.S. 24-4-106, as amended. <br />Dated at Denver this ~~Z day of ~~~ , ~. <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />MICHAEL B. ector <br />Division of Minerals and Geology <br />
