Shelton <br />Director <br />August 26, 19$0 <br />Mr. Darrel Hespe <br />Dorchester-Colomine Coal Company <br />751 Horizon Ct. <br />Grand Junction, Colorado 81501 <br />RE: Assessment Conference <br />Settlement Agreement <br />Dear Mr. Hespe: <br />On August 7, 1980, an assessment/settlement conference was held concerning <br />Notice of Violation 1980-20 served on June 4, 1980. Present at the confer- <br />ence were Messrs. Darrel Hespe and Lee Acre representing Dorchester Coal <br />Company and Fred Banta and myself representing the Mined Land Reclamation <br />Division. <br />At the time of the conference, no conclusions were reached and thus the <br />conference was continued indefinitely. The signing of the enclosed seEtle- <br />ment agreement will constitute the closing of the assessment/settlement <br />conference. <br />The conference has.led to findings which have warranted a reduction in the <br />Proposed Amount of Civil Penalty. The findings are: <br />1. [hat the Dorchester-Colomine Co. made an effort to salvage topsoil <br />prior to construction, even though it is not clear that all soil <br />suitable for plant growth medium was salvaged; and, <br />2. that Dorchester-Colomine Co. failed to submit a technical revision, <br />but the failure amounted to a violation of administrative procedures <br />not warranting the Proposed Amount of Civil Penalty of.$750.00. <br />Therefore, for item 1, failure to salvage topsoil, the Proposed Civil Penalty <br />of $500.00 is reduced to $250.00. For item 2, failure to submit a technical <br />revision, the Proposed Civil Penalty of $750.00 is reduced to $250.00. The <br />total Proposed Amount of Civil Penalty is $500.00.
