<br />-2- <br />NOTICE OF VIOLATION - CML PENALTY <br />The Colorado Mined Land Reclamation Board orders Zigan Sand and Gravel, Inc., to pay <br />a civil penalty in the amount of $1,100.00, within 30 days of the signature date of this <br />document. This is based upon an assessment of $100.00 per day for 71 days of violation, <br />from January 16, 1996 to March 27, 1996, with $6,000.00 suspended upon completion of <br />the corrective action outlined in the March 27, 1996 Board Order, Notice of Violation No. <br />M-96-009. The Corrective Actions from the March 27, 1996 Board Order have been <br />completed. <br />In clarification of the rights of recipients of Notices of Violation, Cease and Desist Orders, <br />parties are advised to consult the Colorado Mined Land Reclamation Act and the State <br />Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts to be performed <br />within a certain time, shall be construed as a permit or license to engage in any prospecting <br />or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are advised to consult <br />C.R.S. 24-4-106, as amended. <br />I <br />d'u <br />Dated at Denver this ~ day of «~ <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br /> <br />iL B.
