Rollings, 370, OSM <br />The Albuquerque Field Office (AFO) received a citizens complaint from Mr. Jim <br />Tatum on December 3, 1993. Mr. Tatum specifically stated that he did not require <br />confidentiality. The letter also stated that he had previously contacted the Division <br />of Minerals and Geology (DMG) about the issues discussed. <br />The enclosed Ten-Day Notice (TDN) and this report are considered an <br />administrative action and not a citizens complaint inspection. <br />A copy of the letter is enclosed for DMG's reference. While some regulations are <br />specifically cited in the letter, there appear to be other regulations in violation also. - <br />A TDN to DMG accompanies this report that lists three violations. The first <br />violation cites regulations that are.all.inclusiye~n~sLbsidencglncluding_i0v~ntoq!~._. _. _ <br />survey, monitoring, and a control plan. This violation addresses most of Mr. <br />Tatum's concerns. The second violation cites the requirement to control adverse <br />impacts on ground water resources which addresses the issue of Mr. Tatum's <br />water well drying up. The third violation rites operation plan requirements because <br />the permit does not show underground mining activities under Mr. Tatum's <br />property. <br />DMG has ten days from receipt of the TDN to respond to AFO. If a response is <br />not received within ten days, or if the response is deemed inappropriate, an <br />immediate Federal inspection will be conducted. <br />
