Dear Mr. McCarthy:
Your requested technical revision of February 15, 1985, has been scheduled
before the Mined Land Reclamation Board (MLRB) at their February 27-28, 1985
meeting.
We have thoroughly reviewed the original application and the subsequent
technical revision in 1980 and the amendment in 1984. This review has
revealed there has been a consistent referral of minimum soil material at this
site and to replacing 4 inches of topsoil onto the reclaimed slopes.
Therefore, we have no problem with agreeing to your request in the technical
revision.
This technical revision will be presented to the MLRB utilizing the written
"No Problem" format. We will recommend the approval to delete reference to
"12 inches of overburden fines and 4 inches of topsoil" being reapplied to the
reclaimed areas and to accept reference to "minimum 4 inches of topsoil
material will be returned to reclaimed areas as referenced throughout the
original application and subsequent modifications".
If you have any questions about this matter, please contact this office no
later than 5:00 P.M. Friday, February 22, 1985 (as we are in the process of
