McCarthy <br /> Conover, McClearn, & Heppenstall <br /> 1775 Sherman Street <br /> Suite 2600 <br /> Denver, Colorado 80203-4322 <br /> Re: Nottingham Sand and Gravel Company (Eagle Pit) - File No. 78-352 <br /> Dear Mr. McCarthy: <br /> Your requested technical revision of February 15, 1985, has been scheduled <br /> before the Mined Land Reclamation Board (MLRB) at their February 27-28, 1985 <br /> meeting. <br /> We have thoroughly reviewed the original application and the subsequent <br /> technical revision in 1980 and the amendment in 1984. This review has <br /> revealed there has been a consistent referral of minimum soil material at this <br /> site and to replacing 4 inches of topsoil onto the reclaimed slopes. <br /> Therefore, we have no problem with agreeing to your request in the technical <br /> revision. <br /> This technical revision will be presented to the MLRB utilizing the written <br /> "No Problem" format. We will recommend the approval to delete reference to <br /> "12 inches of overburden fines and 4 inches of topsoil" being reapplied to the <br /> reclaimed areas and to accept reference to "minimum 4 inches of topsoil <br /> material will be returned to reclaimed areas as referenced throughout the <br /> original application and subsequent modifications". <br /> If you have any questions about this matter, please contact this office no <br /> later than 5:00 P.M.
